1. Acceptance of Terms

By accessing or using the PitStop website, software, and services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

2. Description of the Platform

We provide a dual-purpose platform that serves as:

  • SaaS for Auto Shops: Business management tools, including inventory tracking, staff management, and promotional loyalty programs for automotive service providers ("Service Providers").
  • Marketplace for Vehicle Owners: A directory and booking system for vehicle owners ("Customers") to discover, request quotes from, and book services with Service Providers, as well as leave public reviews.

3. Our Role and Limitation of Liability

PitStop is a technology platform and facilitator. We do not provide automotive repair, maintenance, or inspection services.

  • No Endorsement or Guarantee: We do not guarantee the quality, safety, or legality of the services provided by Service Providers. Any agreement for automotive services is solely between the Customer and the Service Provider.
  • No Liability for Vehicle Damage: Under no circumstances shall we be held liable for any property damage, vehicle damage, bodily injury, botched repairs, or disputes arising from services booked or facilitated through the Platform.
  • Dispute Resolution: Any disputes regarding automotive services, warranties, or refunds for mechanical work must be resolved directly between the Customer and the Service Provider.

4. Account Registration and Responsibilities

To access certain features of the Platform, you must register for an account.

  • Accuracy: You agree to provide accurate, current, and complete information during registration.
  • Security: You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
  • Service Provider Obligations: Auto shops must maintain valid licenses, insurance, and permits required by their local jurisdictions to operate an automotive repair business.

5. SaaS Subscriptions and Payment Terms

The following terms apply specifically to Service Providers utilizing our premium business management tools:

  • Fees and Billing: Access to premium features requires a paid subscription. By providing a payment method, you authorize us (through our third-party payment processor, Stripe) to charge your subscription fees on a recurring basis.
  • Cancellations: You may cancel your subscription at any time. Cancellations will take effect at the end of your current billing cycle. We do not provide refunds for partial months of service.
  • Marketplace Transactions: If the Platform facilitates payments from Customers to Service Providers, we are not responsible for chargebacks, insufficient funds, or fraudulent Customer payments.

6. User-Generated Content and Conduct

Users may post reviews, ratings, and communicate through the Platform. You agree not to post content that is:

  • False, misleading, or fraudulent (including posting fake reviews or manipulating the loyalty program features).
  • Defamatory, abusive, harassing, or threatening.
  • In violation of any third-party intellectual property or privacy rights.

We reserve the right to remove any content or terminate accounts that violate these guidelines or harm the integrity of the Platform.

7. Intellectual Property

All original content, features, and functionality of the Platform (including the underlying code, design, and UI) are owned by PitStop and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from our Platform without express written permission.

8. Termination

We reserve the right to suspend or terminate your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Platform, us, or third parties, or for any other reason.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Indiana.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by posting the new Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after such changes constitutes your acceptance of the new Terms.

11. SMS Terms & Conditions

The following terms apply to SMS text messaging services provided through the PitStop Platform. By opting in to receive SMS messages, you agree to these terms:

  • Opt-In & Consent: Users may opt-in to receive SMS text messages during the appointment booking process or voluntarily via our dedicated consent form at https://mypitstopapp.com/sms-opt-in. Your consent is voluntary and is not a condition of any purchase.
  • Message Types: You may receive appointment confirmations, reminders, vehicle inspection approval requests, and promotional offers.
  • Message Frequency: The frequency of messages depends on your bookings and your engagement with the Platform. message and data rates may apply.
  • Opt-Out: You may cancel the SMS service at any time by replying STOP to any message. For help, reply HELP. Opting out of marketing messages does not affect transactional messages related to your active bookings.
  • Carriers: SMS delivery is supported by major U.S. carriers. We are not liable for delayed or undelivered messages.
